Rasik 2022 LLC d.b.a. BJ Food located at 1471 Rocky Creek Road, Macon, GACommittee of the Whole on June 20, 2023 recommended denial based on the fact that the business did not have the required variety of produce for a Food Mart. They otherwise complied with the definition of a Food Mart. After reinspection, the store now exceeds minimum requirements for a Food Mart. The store appealed the decision.At the hearing, the following stipulations were imposed for the store to obtain a license:MBC agrees to present the Basis for Agreement herein to the Commission at the next reasonable Commission Meeting of the Macon-Bibb County Commission through legal counsel. Upon conclusion of the presentation of the Basis for Agreement, MBC legal counsel shall recommend approval of the Application.Rasik 2022 shall waive its right to hearing pursuant to MBC Code Chapter 4 Article XI. This term shall not be interpreted to preclude Rasik 2022 from pursing an appeal of the Commission's final decision on the Application to the superior court or other appeal or legal remedy as prescribed by law.Rasik 2022 shall continue to offer the products necessary to meet the legal minimum requirement of a Food Mart and otherwise continue to meet the legal requirements to be granted and hold the alcohol licensure for which it applied in its Application.This Agreement does not constitute an admission of responsibility or liability by either Macon-Bibb County or Rasik 2022, nor their respective officers, employees or former officers and employees.Except as expressly provided to the contrary in this Agreement, each party shall bear its own legal and other costs incurred in connection with this matter, including the preparation and performance of this Agreement.This Agreement is governed by the laws of the State of Georgia. The Parties agree that the exclusive jurisdiction and venue for any dispute arising between and among the Parties under this Agreement shall be in any court of competent jurisdiction located in Bibb County, Georgia.For purposes of construction, this Agreement shall be deemed to have been drafted by all Parties to this Agreement and shall not, therefore, be constrained against any party for that reason in any subsequent dispute.This Agreement is effective when executed by both Parties.Legal recommends approval.
